Governed by tort law, personal injury awards given to the victim of a personal injury case can often take years. Tort law protects individuals who have been wronged by another and resulted in the injury through negligence intentional or otherwise. Personal injury attorneys handles the settlements of these cases which are usually awarded from personal injury cases that involve bodily harm. There are two types of awards which may be gleaned from a personal injury settlement with the right attorney. Punitive damages are the court awarded general damages of a defendant that exceeds the economic loss of the defendant. Compensatory damages are the award, usually monetary, that is intended to compensate the claimant for the sustained injury. A personal injury attorney can gain settlements which include: • Loss of income • Mental pain and suffering • Compensation for medical expenses • Disability or deformity In some cases a personal injury attorney can gain a settlement of non-economic damages as well (which would include pain and suffering awards). These may be capped. Punitive damages may be included in the case of wilful or malicious negligence to deter others from similar action and punishing the perpetrator(s). Personal injury settlements may be possible in many different types of personal injury: • Negligence • Strict liability • defective products or drugs • nursing home abuse • slip and fall injuries • car accidents • work related injuries • toxic material injuries • dog bite injuries • drug injuries • medical malpractice • wrongful death First, it must be shown that the defendant did in fact bear a legal responsibility for the injury and second the extent of the damages must be proven In order to receive a personal injury settlement. An injury attorney will best determine if you have a personal injury case or not. |
